1. Agreement to Terms
These Terms & Conditions (“Terms”) govern all services, programs, workshops, events, coaching, speaking engagements, and related offerings provided by Holisera Productions Inc.
By registering for, purchasing, accessing, or participating in any offering, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Nature of Services
Holisera Productions Inc. provides educational, coaching, facilitation, speaking, consulting, and professional development services.
All services are educational in nature only and do not constitute:

medical, psychological, or therapeutic services

legal or financial advice

licensed professional services
No client, therapeutic, or professional advisory relationship is created unless explicitly agreed in writing.
Participants are solely responsible for decisions, actions, and outcomes arising from participation.
3. Eligibility and Participation
Participation is open to adults unless otherwise stated. Some programs may include youth participation with required parental or guardian consent.
Certain offerings may be restricted to Canadian residents or extended to international participants where specified.
Holisera Productions Inc. reserves the right to accept, decline, or remove participants at its sole discretion where necessary to maintain program integrity, safety, or capacity.
4. Inclusive Participation
Holisera Productions Inc. supports inclusive participation and welcomes neurodivergent and diverse participants.
Reasonable accommodations may be considered where operationally feasible.
Participation requires respectful conduct and alignment with program structure.
5. Participant Responsibility
Participants acknowledge and agree that:

no outcomes are guaranteed

they are responsible for evaluating suitability of all information provided

respectful participation is required at all times
6. Program Types
Services may include:

application-based programs
-
registration-based programs
-
coaching and mentorship
-
virtual workshops and programs

in-person events and experiences
-
speaking engagements and contracted educational services for organizations (including schools, corporations, and alternative education programs)
Delivery format, requirements, and access conditions are defined per offering.
7. Payments
All pricing is in CAD unless otherwise stated.
Payment is required to secure participation.
Accepted methods may include Interac e-Transfer, Eventbrite, or other approved systems.
Third-party platforms may apply additional terms and fees independent of Holisera Productions Inc.
Failure to pay may result in cancellation of access or registration.
8. Refunds and Cancellations
Refund and cancellation terms vary by offering and are defined on the relevant sales page, contract, or registration page.
Where conflicts exist, program-specific terms override general policy.
No refund rights apply unless explicitly stated in writing for the specific offering.
9. Scheduling and Changes
Holisera Productions Inc. may modify, reschedule, or cancel services where reasonably necessary due to operational, environmental, or external factors.
Reasonable notice will be provided where possible.
10. Intellectual Property
All materials, content, frameworks, and program structures remain the exclusive intellectual property of Holisera Productions Inc.
Participants may not reproduce, distribute, modify, or commercially exploit materials without written permission.
Personal use for educational purposes is permitted.
11. AI and Content Protection
Participants may not use AI systems, automation tools, or machine learning technologies to:

replicate program content or frameworks
-
generate derivative programs or competing services
-
train datasets using Holisera Productions Inc. materials
Unauthorized use may result in termination of access and legal action.
12. AI Use by Holisera Productions Inc.
Holisera Productions Inc. may use AI and digital tools for administrative, organizational, and content development purposes.
All final content and educational direction remain human-reviewed and approved.
Participants acknowledge possible third-party automated processing.
13. Communication
Official communication occurs only through verified Holisera Productions Inc. channels.
Unverified social media or informal communications are not binding.
No verbal agreements are valid unless confirmed in writing.
14. Conduct and Safety
Participants must engage respectfully and must not engage in:

harassment, discrimination, or intimidation
-
disruptive or unsafe behaviour
-
conduct that interferes with group learning or safety
Holisera Productions Inc. may restrict or remove participants where necessary to maintain safety or integrity.
15. Zero Tolerance Removal
Holisera Productions Inc. enforces a zero-tolerance policy for behaviour that threatens safety, dignity, or wellbeing.
This includes:

threats or abusive conduct
-
unsafe physical or verbal behaviour
-
hate-based or discriminatory conduct
-
refusal to follow safety or facilitation instructions
Violation may result in immediate removal without warning or refund.
16. For-Hire Services (Speaking, Training, Educational Contracts)
Holisera Productions Inc. may be contracted by organizations including schools, corporations, homeschool groups, and alternative education programs.
The client is responsible for:
-
participant supervision and duty of care
-
safe physical or virtual environments
-
required consents (including parental consent where applicable)
-
logistics and technical setup
Holisera Productions Inc. is not responsible for supervision outside scheduled delivery time.
Terms, payment, cancellation, and scope are governed by the applicable contract or invoice.
17. Technology and Third Parties
Holisera Productions Inc. is not liable for failures, outages, or data practices of third-party platforms or systems used in service delivery.
18. Recording and Media
Recording may be restricted or prohibited during sessions.
Group sessions are not guaranteed to be recorded.
Independent recording by other participants cannot be controlled or prevented.
19. Limitation of Liability
To the fullest extent permitted by law, Holisera Productions Inc. is not liable for:

indirect, incidental, or consequential losses
-
financial or business outcomes
-
emotional or psychological impacts
-
reliance on provided information
-
service interruptions or external failures
All services are provided for educational purposes only.
20. Brand Protection, Fraud, Cybersecurity, and Media
Holisera Productions Inc. protects its brand, identity, systems, and intellectual property.
20.1 Press and Media
No individual may represent Holisera Productions Inc. publicly without written authorization.
Media or press use of the brand must be pre-approved.
20.2 Fraud and Impersonation
The organization is not responsible for:
- impersonation
- fake accounts or websites
- fraudulent communications
- misuse of branding or identity by third parties
20.3 AI Misrepresentation
The organization is not responsible for AI-generated or synthetic content, including deepfakes or manipulated media.
20.4 Cybersecurity
Reasonable security measures are maintained; however, no system is fully secure.
Holisera Productions Inc. is not liable for unauthorized access, hacking, or cyber incidents beyond its reasonable control, but will take reasonable mitigation steps where possible.
21. Privacy
Personal information is handled in accordance with the Privacy Notice.
22. Chargebacks
Participants agree to resolve disputes directly before initiating chargebacks and acknowledge that services delivered in accordance with stated terms are not eligible for reversal.
23. Additional Agreements
Some services require separate signed agreements, intake forms, or consent documents. These operate in addition to these Terms. Where conflict exists, signed agreements prevail.
24. Governing Law
These Terms are governed by the laws of Ontario, Canada.
25. Severability
If any provision is found unenforceable, remaining provisions remain valid.
26. Entire Agreement
These Terms, together with the Privacy Notice and Refund Policy, form the full agreement.
27. Electronic Acceptance
Electronic acceptance constitutes binding agreement.
28. Updates
Holisera Productions Inc. may update these Terms at any time. Continued participation constitutes acceptance of changes.
